The Energy Policy Act of 2005 (EPACT) allows for a tax deduction of up to $.60 per square foot if certain milestones are achieved for the building owner or the tenant (whoever pays for the new lighting controls/system). In addition, if the lighting controls/system is placed in service on a government-owned building (federal, state or local) the deduction can be allocated to the “designer” of the project (It is not applicable for 501(c) entities/not-for-profits or sovereign nations). New legislation has also enabled companies to capture all deductions they are entitled to for lighting controls placed in service from 1/1/2006 forward without amending one single tax return.
